To the extent that the website and the information and services on the website are provided free-of-charge, we will not be liable for any loss or damage of any nature.

Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, we may take such action as we deem appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

We may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the use of our website from the date of the publication of the revised terms and conditions on our website. Please check this page regularly to ensure you are familiar with the current version.

We may transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.

You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect

These terms and conditions are for the benefit of you and us, and are not intended to benefit any third party or be enforceable by any third party. The exercise of our and your rights in relation to these terms and conditions is not subject to the consent of any third party.

These terms and conditions will be governed by and construed in accordance with English law, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of England and Wales.

Orders

By placing an order via our website (www.thebicyclesociety.org)  you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Please read and check your order carefully before submitting it. If you need to correct any errors you can do so before submitting it.

When you place an order at the end of the check-out process (by clicking “Buy Now” or “Proceed to checkout”), we will send you an acknowledgement e-mail confirming receipt of your order. This email is an order acknowledgement and does not mean that we accept your order. We may reject your order for the following reasons:

  • the goods are out of stock or unavailable;
  • we cannot authorise your payment;
  • we reasonably believe that your order contravenes our Fair Purchase Policy (set out below);
  • we are not allowed to sell the goods to you;
  • you are not allowed to buy the goods from us; or
  • there has been a mistake on the pricing or description of the goods.

A contract between us for the purchase of the goods will be formed when your payment has been approved, the prices have been verified, and the order has been processed and dispatched. A second email will be sent confirming these arrangements and you will not have ownership of the goods until they have been dispatched.

In order to contract with TBS  you must be over 18 years of age. TBS retains the right to refuse any request made by you.

Delivery

We will either deliver the goods ourselves as part of TBS Membership or use trusted third party logistics providers to deliver our goods. If you want to know your delivery options, please contact us at info@thebicyclesociety.co.uk

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or other occurrences beyond our control for which we will not be responsible.

If there is a delay in delivering the goods we will inform you of this via email and the goods will be despatched as soon as available.

Occasionally we find ourselves having to withdraw an item because it has become obsolete or has been discontinued. If you have placed an order for an item that has been made obsolete we will inform you as soon as possible and offer you an alternative if one is available.

Delivery of the goods will occur when we deliver them to the address you provide us with when you make your order. You are responsible for the goods when delivery has taken place.

We may need to deliver your goods in separate instalments. If that is the case we will let you know in advance.

If your delivery address is in the Scottish Highlands & Islands, Isle of Man and Northern Ireland, delivery times and costs may be extended depending on the exact location.

Deliveries cannot be made to PO Box addresses. We strongly advise against deliveries to be made to hotels or third party couriers. Any orders made, to be sent to a hotel or a third party courier, are entirely at your own risk once delivery has been made by our logistics provider.

Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel the order and you have already paid for the goods, you will receive a full refund.

The website may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fulfil any orders that you may place based on information on the website that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.

Payment

Payment can be made via our secure check out pages using your credit or debit card (details of accepted credit or debit cards are provided during the checkout process). You can also pay using Bank Transfer for Electric Bike Purchases to (E Bike Demo Days) or PayPal or PayPal Credit. Card charges will appear on your statement as “TBSUK Limited”.

When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card, bank account or PayPal account used to place your order and that there are sufficient funds to cover the cost of the goods.

The cost of international products and services may fluctuate.

All prices are quoted in pounds sterling (£) and include Value Added Tax (VAT) where applicable.

Pricing

All prices listed on www.thebicyclesociety.org  are correct at the time of entering. Your credit card or debit card will be charged at the point of purchase unless your items are pre-order items in which case we will not charge your credit or debit card until the items are back in stock and ready to be dispatched.

If a genuine error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. We shall be under no obligation to fulfil an order for a product that was advertised at an incorrect price. In the event that you order an item and the price published on www.thebicyclesociety.org is incorrect for any reason, we will email you to inform you that we have not accepted your order, and shall refund any amount already paid to us.

Due to the nature of the clearing system your credit card payment will be taken at the point of processing. If a problem in supply should occur, your payment method will be refunded as soon as possible. The refund may take a couple of days to show as cleared funds on your account, depending on payment provider.

If your delivery address is outside of the UK, you may be required to pay import duties and taxes when your TBS order reaches your destination country. These and any additional charges for customs clearance are your responsibility. All orders are fulfilled and despatched from the UK.

Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the “Total”.

Privacy

Any personal information that you provide to us will be dealt with in line with our Privacy Policy which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.

Returns and Cancelation Policy

We offer a very helpful and hassle-free returns policy, after all, we are here to help you feel confident with your new purchase.

You also have rights under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 which state that up to 14 days after receiving your goods, in most cases, you can change your mind and get a full refund. You have the right to cancel this contract within 14 days from delivery without giving any reason. This right does not apply to any customised or personalised goods bought through our website. To exercise this right please Contact Us prior to the expiry of the cancellation rights period.

If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

We will make the reimbursement without undue delay, and not later than:

  • 14 days after the day we received back from you any goods supplied; or
  • (if earlier) 14 days after the day you provide evidence that you have returned the goods; or
  • if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product you’re entitled to the following:

  • up to 30 days: if your goods are faulty, then you can get a refund;
  • up to six months: if they can’t be repaired or replaced, then you’re entitled to a full refund, in most cases;
  • up to two years: if the goods do not last a reasonable length of time, you may be entitled to some money back.

TBS will not be liable for any returns shipping costs nor installation of any warranty parts for a Manufactures Warranty.  TBS do not manufacture any items listed on the website and each manufactures warranty will vary. Whilst we will act as agents to get your issues resolved we can not provide financial reimbursement for a faulty manufactures item, unless returned in the The Consumer Rights Act 2015 .

Please ensure that you have read your manufacturers warranty conditions before attempting to install a part or otherwise repair item. We cannot be held responsible if the item is damaged or your warranty is voided. Some manufacturer guarantees may be on condition that you use a qualified cycle technician.

Nothing in this contract affects your legal rights under the Consumer Rights Act 2015 (also known as ‘statutory rights’). You may also have other rights in law.

Please contact us, if you want:

  • us to aid with a warranty request
  • us to replace the goods;
  • to reject the goods and get a refund.

Warranty Policy

We work hard prior to dispatching your product to make sure it never comes back as a warranty issue. We get how frustrating warranty problems can be and our aim is to assess any problems, find a resolution and get you back out using your product as quickly as we can. As with all warranty though there are some things you need to know:

Our policy does not affect your statutory rights.

TBS will not accept abuse towards staff and can refuse communication if necessary.  We do not warrant against failure or damage due to misuse such as, but not limited to incorrect installation, poor maintenance, abuse or neglect, using the product for something other than its intended purpose, alteration of the product unless expressly permitted in writing by TBS.

TBS does not cover general wear and tear on tyres, inner tubes, brakes, brake and gear cables, brake pads, light bulbs, chain rings, chains, cassettes, rims, batteries etc.

Corrosion and/or deterioration caused by material fatigue defined as the natural breakdown of materials that occurs after extended use will not be covered under warranty.

After the initial 30 day period TBS reserve the right to repair/replace any defective part under warranty.

Warranty is non transferrable and applies to the original purchaser only. Proof of purchase is required with all potential warranty claims.

Any item that is repaired or replaced under warranty will be covered by a period equal to the remaining warranty period of the original part.

Usage during competitions, events, circuits or activities other than those for which the bicycle/component has been conceived will greatly reduce its useful life and is not covered under warranty.

Costs incurred as a result of loss of use, as well as labour charges for part replacement or changeovers are not covered.

If a repair/replacement is not possible TBS reserve the right to offer an alternative of equal or greater value (colour may vary) or a partial refund proportional to the remaining life of the product.

Always install, repair and use your product in strict compliance with the product’s instructions; failure to do so might damage the products and cause a serious accident.

How to Claim

All goods purchased from TBS are covered by a full warranty and, generally speaking, warranties cover manufacturing faults and defects including poor workmanship. If you feel that your purchase has developed a fault, then please email us before returning any goods – we may be able to solve your problem without you incurring any postage costs.

To get the fastest resolution all you have to do is:

1 – Send us your frame number, name, address, purchase date

2 -Take a few photos of the issue you wish to claim warranty against.

3 -Email the claim information and photographs to

We will then get in contact with you for the next steps in completing your claim. Please be honest when dealing with us, we’ll try our best to resolve any problems you have as it’s in our interest to have a happy customer!

Course bookings terms

Our courses are designed to make you feel safe, confident and independent when cycling.  We have designed the course duration and timescales to suit all ages and abilities over many years and tens of thousands of participants. We work hard to endure you have a positive experience. If you feel the experience was below expectations please notify us immediately by contacting our CEO – (rob@thebicyclesociety.co.uk) We PRIDE ourselves in delivering an exceptional services and value your feedback for what ever reason. We will go out of our way to make up for any short comings from our admin, coaches or overall service.

Cancellation Policy:

Cancelations are transferable to another course or participant 14 days prior to the booed course. Cancelations  within 14 days are non transferable and non refundable.
 Each course can be booked onto via our personalised booking service, or pre booked onto our website.

Learn to Ride guarantee is for ages 4+. Children aged 3 and under can take part in the lessons, however there is no guarantee they will learn to ride a bike.

Wet weather:

All lessons will go ahead unless torrential rain. The cancelling of a lesson will be discussed with you and no cost penalty for a missed session, for weather or child / family illness.

Clothes:

Long trousers and sturdy shoes are essential to reduce any inevitable bumps from the bike. If cold please bring gloves.

Injury / upsets.

Learning to cycle carries potential hazards from slips, trips,  falls and scratches. Although we try to minimise these bumps are inevitable from time to time. Signing up to any course means you understand these risk and will not hold TBS coaches or TBS accountable for injuries through use of equipment or facilities. While we do everything in our power to create highly positive learning environments, from time to time  it is expected that there will be tears from participants, from frustration, exhaustion of family pressure. the grown up responsible for the participant accepts child frustrations can lead to tears and will not hold coaches accountable for such incidents.

Our Guarantee:

If by the end of the planned lessons your child needs more support in learning to pedal we will continue to deliver lessons for free. The additional lessons if needed will be booked at a future convenient date. Participants must arrive on time.

If any participant is later than 15 minutes (unless agreed in writing by TBS) they will not receive the learn to ride guarantee. If a participant is a no show and did not notify us of absence they do not receive the Learn to Ride Guarantee. Participants can continue the planned lessons, however to received the guarantee they must purchase a full course.

When receiving the additional free lessons these will be booked one lesson at a time until participant can cycle independently.

When a participant (especially young children) has learnt to cycle with us they must keep practicing using our “secrets of cycling”. Once a participant has received a certificate confirming they can ride and have been signed off by a coach they are confirmed as an independent rider; meaning they can start, ride (for 30 seconds) and stop independently. Certain bikes can be more difficult than others to ride, if the participant can not cycle on their bike at home, but has learnt on a smaller light weight bike with us, we highly recommend the purchase of a lighter / smaller bike to keep them practicing.

Any subsequent free lessons offered in the learn to ride guarantee must be delivered within one calendar month  from the final pre booked lesson unless permission to extend by TBS in writing.

Expiry.

All lessons have a year expiry from date of purchase. If your child had learnt to cycle with us and is no longer confident, I.e they hadn’t practiced and can no longer ride. Top up lessons can be naught for £45 per hour.

Membership Terms and Conditions

We are here to support our members to access safe, easy and convenient bike rides. We are working towards a society built for bicycles and therefor take every suggestion from our members onboard. We are here for you. All offline benefits and services must be redeemed with one calendar year from purchase date and do not roll on to the following year.

Free Membership: Eligible for online benefits and discount purchases.

Household Membership: Eligible for online and offline benefits.

Household refers to residence of the same household, generally compromising of two adults and teenagers / children. A household membership is not limited to biological parents and includes all cases of fostering, carers, adoptions etc. The general aim is to cater for all participants living in the same household. Where we feel that members are including participants and/or bicycles from other households we reserve the right to refuse to include said participants/bicycles in the booked service.

The household membership does not include young professionals in a house sharing situation, nor multiple families residing in the same ‘household’.  If you are unsure if  your circumstances fall into household or individual, or if we can include all of your residence of your household please email info@thebicyclesociety.co.uk for any enquiries.

Offline services.

Household Membership – Personalised skills sessions total of four hours and a maximum of two visit per year included.

These are booked directly with your membership coordinator on a mutually agreed date, time and location. They cover balance bike lessons, learn to ride, route planning, maintenance lessons, led bike ride, BMX skills, Mountain bike skills, road awareness training, riding with children, preparing for a bike ride etc. We tailor our skills sessions to cater for your location and requirements. Sessions can be extended at a cost of £50 per hour. If a member is more than 15 minutes late or is a no show, the session will be cancelled and non refunded.

Mechanic Call Out, covers one bike per household member. To be redeemed once a year and booked directly with the maintenance company in your area. Quote your TBS membership number to redeem your bike checks. As we work with various mobile mechanic companies the prices vary across the country.. The “Mechanic Call Out” includes a road safety check with minor adjustments to items such as brake cables, gear cables, minor truing wheels, cleaning and oiling items etc. If the callout mechanic decides that the bicycle needs a mechanical replacement part, such as inner-tube, tyres, wheels, drive-chain, hydraulic brake bleed etc, or additional time is needed to make the bikes suitable to ride,  additional costs will be additionally quoted by the maintenance company. All costs will be discussed prior to commencing any addition work. In the event of a part being needed to complete the repair, a return date and time will be arranged directly with the household all all items purchased at the point of re booking a Mechanic Call Out. Alternatively, an advisory list of work required to make the bicycle roadworthy can be provided.

To book your mechanic call out, email us directly at bookings@thebicyclesociety.co.uk and we will send you to our nearest partner. Your booking will be directly with them and may involve a small callout charge. This will be paid directly to the third party company as well as any additional items needed to get your bikes up and running.

Feedback – If you encounter any services that are below expectations for whatever reason please email our CEO rob@thebicyclesociety.co.uk at your earliest convenience.

Nominate a school. We ask all Household members to nominate a local school for cycle sessions. Once a school has 20 nominations (one nomination per household membership), The Bicycle Society will provide 2-days of biking school for free! A maximum number of 120 pupils can be taught in any one day. All services are subject to schools requirements. Two Free days entails the provision of two coaches working with a maximum ratio of 1:15 in the playground and 1:4 on road.

Individual Memberships:

Individual Membership – Personalised Skills Session total of two hours and one visit per year. Individual Members can invite up to four others to join in when COVID guidelines allow. Tailor made for your requirements.

These are booked directly with your TBS membership coordinator on a mutually agreed date, time and location. They cover balance bike lessons, learn to ride, route planning, maintenance lessons, led bike ride, BMX skills, Mountain bike skills, road awareness training, riding with children, preparing for a bike ride etc. We tailor our skills sessions to cater for your location and requirements. Sessions can be extended at a cost of £50 per hour. If a member is more than 15 minutes late or is a no show, the session will be cancelled and non refunded.

Nominate a workplace. We ask all individual members to nominate their workplace for cycle sessions. Once a workplace has 20 nominations (one nomination per individual membership), The Bicycle Society will provide 1-day of biking skills for free! A maximum number of 120 people can be coached in any one day. All services are subject to workplace requirements. One Free day entails the provision of two coaches working with a maximum ratio of 1:15 on a basic skills session, 1:6 on a medium to advanced sessions including mountain bike rides  and 1:4 on road sessions.

All lessons and offline services  expire after a year from date of purchase.

Online services:

TBS is not liable to any agreement or contact made between a TBS member and a service or product purchased through our membership benefits links. If you encounter an issue with a participate brand please try to resolve the issue with them directly. We are here to serve our members and have chosen our partnership benefits to enhance your life through freeing your time or saving you money. Please notify us at info@thebicyclesocietyco.uk if  you feel an issue has escalated and we should be notified.

For refunds and returns on Membership purchases please email info@thebicyclesoceity.co.uk in the first instance. A full refund will be provided within our refund policy, any skills sessions delivered delivered before a 14 day cancellation period will be deducted off the refund.

Upon submission of your email and personal details  via our contact/purchase form, The Bicycle Society will not store, share or sell your details. Your information will solely be used for the purpose of responding to your enquiry. Newsletter

Our newsletter subscription is operated through Mailchimp. We will save your contact details, but will not share or sell any information with Third Party Companies. Your data is safe with us, but of course, you are free to unsubscribe at any time.

If you leave a comment on our site you may opt-in to save your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

The Bicycle Society does not share or sell your data with any Third Party companies.

How long we retain your data

If you sign up for The Bicycle Society newsletter, we will retain your submitted data indefinitely until a time when you choose to opt-out.

What rights you have over your data

If you have an account on this site or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

How we protect your data

All data is transmitted via an encrypted connection using an SSL certificate issued by INSERT.

Media Consent

In accordance with our child protection policy, we will not permit photographs, video or other images of young people to be taken without the consent of the child or the parent if the child is under 16.

The Bicycle Society will take all steps to ensure these images are used solely for the purposes they are intended; The Bicycle Society’s website, social media channels and for marketing purposes. The Bicycle Society is creating a documentary to inspire more children and families to cycle. Will not sell or trade these images with third parties. If you become aware that these images are being used inappropriately, you should inform The Bicycle Society (TBS) immediately.

The Bicycle Society will store all images and video on a secured Google Drive whereby access is solely permitted to employees of the Bicycle Society.

You can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Bicycle Hire Agreement

Once bikes are out on a loan agreement they may be used for travel to and from school/ work, family bike rides or personal recreational cycling for the duration of the loan agreement. 

This agreement allows the named people in the loan agreement to take temporary responsibility for the safe transport, storage of the bike for the agreed loan period.

It is the responsibility of the named people in the loan agreement to ensure that they wear appropriate cycling clothing and safety equipment e.g. a good fitting helmet, gloves, suitable footwear and leg wear, whenever they go cycling. 

It is the responsibility of the named people in the loan agreement to keep and maintain the bike in good working order and keep it clean for the duration of the agreement.

This includes:-

  • Ensuring that the bike is stored in a safe and secure environment to minimise the risk of theft or accidental damage during the loan period, using either the lock provided or if preferred a personal lock.

  • Ensuring that the tyres are kept at the correct pressure and that the essential working components of the bike are in good working order to the best of your ability.

  • Returning the bike in the same good safe condition as it was at the start of the loan period.

  • Ensuring all name people rides safely and complies with road safety requirements.

  • Not to use the bike for more than one person at a time.

  • Not to tamper with the bike or make temporary or permanent modifications that would compromise the manufacturer’s warranty agreement or recommendations.

  • Informing The Bicycle Society immediately of any concerns regarding the roadworthiness of the bike.

It is the responsibility  of named people on the loan agreement to return the bike on the date [Select on website}   time 10:00am to 3:30pm unless agreed with shop specified at the end of the loan agreement.

You can return the bike before the end of the loan agreement.

Any accidents that occur with the anyone whilst using the bike on the loan agreement involving them individually, or a third party will not be covered by the The Bicycle Society’s insurance and will remain the responsibility of the of named people on the loan agreement to deal with via their own approach or their insurance policy. 

The Bicycle Society will not be liable for any third party claims.

The Bicycle Society will charge any damages to the named people on the loan agreement through the card details held as security deposit. If this card has insufficient balance to cover the damages additional payment options will be requested. All charges will be discussed with the named people on the loan agreement prior to any charges being made. Fair wear and tare usage is expected. 

In the event of loss or theft the named people on the loan agreement must provide a crime reference number. 

Photo ID with corresponding address must be shown on the hire day at the shop.
